The famous case of the Competition Commission of India vs DLF, in which DLF was penalized Rs 630 crores, set the stage for the property buyers revolution. If there are thousands of cases that buyers are today fighting and winning against the builders, it can be directly traced to the CCI Vs DLF case and the tenacity of a handful of buyers who took on the might of India's largest and most dominant company called DLF. Now, another potentially historic case against Raheja Developers is winding it's way through the courts, but a few buyers of Raheja Atharva are already starting to betray the cause and eagerly turn traitors. This is the story of that betrayal and its ramifications for the rest of the buyers ....
The Raheja Developers case is very important because it takes off from where CCI left off. Few people realize that the CCI case was not only against DLF, but also against HUDA (Haryana Urban Development Authority) and DTCP (Directorate of Town & Country Planning), and incidentally fought by the same lawyer, Shri ML Lahoty, who is now representing the Atharva buyers against Raheja Developers in the National Consumer Disputes Redressal Commission.
The CCI had recognized that the DTCP & HUDA were as complicit in the whole "dhandli" of real estate, but Competition Commission of India (CCI) was only seized of the competition issues, and hence left the fate of DTCP & HUDA for another day. This day of judgement for DTCP is now coming in the cases that Raheja Atharva residential complex buyers have filed against Raheja Developers. DTCP is a main actor in this case, and all its collusion and corruption may soon be laid bare in the halls of the honorable courts. The just fate that DTCP and other departments escaped in the CCI vs DLF case may soon befall them. It seems that even the builder (and the departments who may be pressurizing the builder) is now realizing that weakness of their case, and hence is trying to find ways in which to get the cases against them withdrawn. Experts believe that the cases against the Departments & Raheja Developers are very strong, and are expecting a favourable and historic decisions in the honorable courts.
Raheja Developers is now looking for the next "Joey & Khanna" (the ones who withdrew their case in Raheja Vedaanta by misleading their group of buyers) amongst the Atharva buyers so they do not have to face reckoning in the courts. Some buyers are now turning traitors, and spreading false information amongst their fellow buyers to mislead them, and like Joey & Khanna saying that their own case is weak; and that Raheja has "shown" them all the documents and according to them they are all in place. All are lies, and the best place for these lies to be exposed is the honorable courts.
The aim of these Atharva traitors is to get the cases withdrawn, thus saving Rahejas and all the departments who have colluded with them from facing action for their misdeeds. It is ironic that the traitors on behalf of Raheja are reaping the benefits of their betrayal, yet have themselves put very little effort in bring the cases to the strong stage where they are now. Mehnat kuch nahi, per chori chori malai khana chahate hain!
This will be a betrayal of millions of aggrieved buyers who are approaching the courts in hopes of justice, who will need to base their cases on the precedent set in the cases against Raheja. The cases against Raheja must be fought to their logical conclusion, so that they efforts of so many will result in good for society.
In the fresh glow, here in India, where we as a nation have reasserted ourselves with "surgical strikes" executed by the gallant Indian Armed Forces, it is pertinent to consider what the Armed Forces do to traitors - they shoot traitors to death.
In their fight for justice against badmash builders, buyers must understand the designs of these traitors who a few days ago met Rahejas, and now are calling all & sundry on Raheja's behalf. Instead of waiting for divine justice, buyers must turn into god's instruments themselves, and teach these traitors a lesson that they will never forget.
